Terms and Conditions
The use of the facilities at The Firm naturally involves the risk of injury to you or your guest, whether or not you or someone else causes it. As such you understand and voluntarily accept this risk and agree that The Firm (David’s Body Shop, dba.,The FIRM) will not be liable for any injury, including and without limitation to personal, bodily, or mental injury, economic loss or any damage to you, your spouse, guest, or relatives resulting from the negligence or other acts of The Firm or anyone else using the facilities. If there is a claim by anyone based on any injury, loss, or damage described here, which involves you or your guest, you agree to (1) defend The Firm against such claims and pay The Firm for all expenses relating to the claim and (2) indemnify for all liabilities to you, your spouse, guest, relative, or anyone else resulting from such claims. I understand that although The Firm facilities, equipment, services, and programs are designed to provide a safe level of beneficial exercise and enjoyment, there is an inherent risk that use of such items may result in injury to me. Therefore, I hereby agree to specifically assume all risk of injury to me while using any of The Firm’s facilities, equipment, services, or programs and I hereby waive any and all claims or actions I may have against The Firm or its owners and employees as a result of facilities, equipment, services, or programs, and I hereby waive any and all claims or actions I may have against The Firm or its owners and employees as a result of such injury.
COVID-19 WAIVER By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 by attending the The FIRM and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at the The FIRM may result from the actions, omissions, or negligence of myself and others, including, but not limited to, employees, vendors, and other clients/members.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with my attendance at the The FIRM or participation in group fitness classes and or training (“Claims”). On my behalf, I hereby release, covenant not to sue, discharge, and hold harmless The FIRM, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the The FIRM, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any FIRM program.
ON DEMAND & PHOTO/VIDEO RELEASE
•I, hereby grant and authorize The FIRM MPLS the right to take, edit, alter, copy, exhibit, publish, distribute and make use of any and all video taken
of me to be used in and/or for any lawful purpose.
•This authorization extends to all languages, media, formats and markets now known or later discovered.
•This authorization shall continue indefinitely, unless I otherwise revoke this authorization in writing.
•I waive the right to inspect or approve any finished product in which my likeness appears.
•I understand and agree that these materials shall become the property of David’s Body Shop, dba., The FIRM and will not be returned.
•I hereby hold harmless and release David’s Body Shop, dba., The FIRM from all liability, petitions, and causes of action which I, my heirs,
representative, executors, administrators, or any other persons may make while acting on my behalf or on behalf of my estate.
Monday – Thursday 6:00am-8:00pm; Friday 6:00am-7:00pm; Saturday 6:00am-1pm; Sunday 8:00am-12pm
• The Firm will be closed on certain holidays during the year. Holiday hours will be posted throughout the club.
• The Firm reserves the right to change hours at any time and reserves the right to close one week of the year for maintenance purposes.
• FOR YOUR SAFETY: No admittance 10 minutes after classes have started.
• The Firm reserves the right to add or eliminate classes, services or hours of operation at any time.
• The Firm does not provide babysitting or day care for our clients or employees. Children under the age of 16 must be accompanied by an adult at all times.
2. PERSONAL PROPERTY
• The Firm shall not be liable for the loss or damage of property belonging to members and their guests, including money or jewelry, in or about the club.
3. GYM AREA
• Certain hours of the week, The Firm reserves the right to hold classes in the gym area
• There will be times when Firm trainers will be training individuals or small groups in the gym area
• Please limit your cardio workout to 30 minutes if others are waiting.
• All personal training and instruction are to be given by The Firm’s personal trainers only.
• Dumbbells are not to be used on the cardiovascular equipment.
• Any member who is loud, offensive, uses profanity, is bothersome to other members or staff, or who otherwise behaves in an unbecoming manner
or who is cited for infractions of
the bylaws, may be suspended or terminated from the club.
• Management reserves the right to change, add, delete or amend any regulations at any time.
7. BILLING
• Monthly dues and charges are debited from members’ accounts through
an Electronic Funds Transfer on a monthly basis and reflect that month’s dues along with the previous month’s uncollected dues, Personal Training and Juice Bar balances.
• We reserve the right to automatically refer accounts that are delinquent to our collection agency.
• When a house account balance reaches $20, the amount will be automatically debited from banking information on file. Additionally, all miscellaneous fees will be paid on the first of each month.

I understand, from time to time, pictures or video are taken at The FIRM of people participating in various activities. I agree to allow David’s Body Shop Inc., dba The FIRM (Hereinafter The FIRM), its agent’s officers, principals, employees and volunteers to use picture(s), film and/or likeness of me for advertising purposes. In the event I choose not to allow the use of the same for said purpose, I agree that I must inform The Firm in writing.
10. CANCELLATION POLICY /CHANGE OF
STATUS
Cancellation require 5 business days advance notice before the 1st of the month.
