Terms and Conditions

The member covenants and agrees that Stefanie Western DBA: Surge Cycling Studio shall not be liable, responsible or in any way accountable for any loss , injury, death or damage to persons or property which at any time during the term of this contract may be suffered or sustained by the Member or by any person who may at any time during the term of this contract be using or occupying or visiting the Premises or be in, or on or about same. Said covenant and agreement applies whether such loss, injury, death or damage shall be caused by or in any way result from or arise out of any act, omission, or negligence of the Member as a user of the Premises. The member shall indemnify, protect,defend, hold and save Stefanie Western DBA: Surge Cycling Studio free and harmless of, from and against any and all claims, liability loss or damage; provided, however, that the forgoing indemnity and hold harmless shall not apply in the event such claims, liability, loss or damages shall be caused solely by the negligent acts or omissions of Stefanie western DBA: Surge Cycling Studio, their agents or employees.
