WAIVER AND RELEASE OF LIABILITY

In consideration of and as an inducement to my enrollment and payment of fees to become a student of Bring it Om Yoga (hereinafter “BIOY”), I represent and agree as follows:

(1) I (hereinafter “I” or “applicant”) have been examined by a licensed Physician within the past six months and have been found by such physician to be in good health and full able to perform all Yoga exercises which I am to learn and perform during my enrollment with BIOY.

(2) The use of the facilities at BIOY naturally involves the risk of injury to me and/or my guest(s), whether I or someone/ something else causes it. As such, I understand and voluntarily accept this risk. I agree that BIOY, its employees, officers, directors, shareholders, agents, and contractors will not be liable for any injury or damage, including, without limitation, personal, bodily or mental injury, economic loss, or any damage to me resulting from the negligence of BIOY, its employees, officers, directors, shareholders, agents, and contractors, or anyone using BIOY’s facilities. I waive any claims arising from my use of BIOY’s facilities whatsoever or from mere presence on the premises of a BIOY studio.

(3) I understand and agree that I will receive instruction in Yoga theory and exercise only and that I hold harmless BIOY, its employees, officers, directors, shareholders, agents and contractors for any damage to or theft of personal property on or away from BIOY’s premises, or personal injury, including but not limited to bodily injury, disease, disability, death, humiliation, or consequential loss of any kind arising out of my participation in any BIOY event or activity.

(4) In the event that I am pregnant, I will not attend a yoga class until I have discussed the potential risks to me or my unborn child / fetus with my obstetrician. I agree that I will follow my obstetrician’s recommendations and on behalf of myself, my heirs, spouse or other interested party hold harmless BIOY for any possible injury to myself or my unborn child / fetus.

(5) If I am under 18 years of age, I will disclose my age to BIOY and provide my signature and the signature of my parent or legal custodian or guardian at the studio prior to taking class.

(6) Proper athletic attire is required. No street clothes or shoes are permitted in the fitness area unless expressly approved in advance by a BIOY employee. BIOY has the right to prevent the participation in a class if proper attire is not worn.

(7) Alcohol, drugs (including steroids), and smoking are prohibited within BOY facilities. You agree not to use BIOY facilities or engage in any BIOY-related activity under the influence of drugs, alcohol or medication that may impair your ability to participate in the applicable activity or operate any equipment. No weapons of any kind are allowed. No photography, videotaping, filming or audio recording is permitted within BIOY facilities without the express written consent of BIOY management. BIOY reserves the right, in its sole discretion, to limit the consumption of food or beverages, or to the use of outside equipment within BIOY facilities.

(8) Registration fees and Tuition for classes paid hereafter are non refundable. You agree to the payment terms and conditions.

(9) If you are practicing in a BIOY location that offers reservations, please reserve classes in advance using our website or mobile app. Walk-ins are welcome, however students who have pre-booked or are on the waitlist will have first preference. You can reserve classes online up to the class start time, however, for all classes booked 4 hours or less from the class start time, you will be charged a late cancel/no show if you do not attend the class, which fee may be charged against your credit card on file.

(10) Any dispute arising out of or relating to this Waiver and Release of Liability, or the breach hereof, shall be finally resolved by arbitration by a single arbitrator, administered by the American Arbitration Association under its Commercial Arbitration Rules, and judgment upon the arbitration award may be entered in any court having jurisdiction.

(11) Any provision not in conformity with the law of any state or governing body having jurisdiction is hereby severed from this contract and the remaining provisions remain enforceable. To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence on the part of Bring it Om Yoga its agents, and employees.

In the event that I should require medical care or treatment, I agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance. In the event that any damage to equipment or facilities occurs as a result of my or my family's willful actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any actions of neglect or recklessness.

By electronically signing or otherwise electronically accepting and agreeing to this Agreement on your own behalf or as the parent or legal guardian of a minor, you are certifying that you are at least 18 years old and that you have carefully reviewed, fully understand and agree to all provisions of this Agreement. You further understand and agree that you are responsible for all payments described herein.
