Terms and Conditions

In consideration of my participation in the training provided by EvoFit I, myself, my heirs, executors, administrators or assigns, do hereby release, waive, discharge and covenant not to sue EvoFit, its independent contractors, trainers and/or its managers, officers, directors, agents, members, and affiliated entities (Hereinafter referred to as “Releases’”) from liability, from any and all claims, including the negligence resulting in personal injury, accident or illnesses (Including Death) and property loss arising from, but not limited to, participation in the training and use of facilities, premises or equipment wherever located and by whomever provided.

ASSUMPTION OF RISK:

I am aware that all activities associated with personal training instruction from EvoFit and its Releases including, but not limited to activities involving aerobic exercise, stretching exercise, running and weight lifting, as well as additional strenuous exercise and/or exertion of strength, and other sustained physical activities which place stress on the cardiorespiratory and muscular systems (collectively referred to as “Training”), are and can be hazardous activities that include certain risks and dangers, including but not limited to, catastrophic injuries, including paralysis, other serious injury and death. I VOLUNTARILY ACCEPT FULL RESPONSIBILITY OF ALL RISKS INVOLVED, INCLUDING RISKS FROM PARTICIPATING IN ANY WAY IN THE TRAINING, USE OF EQUIPMENT PROVIDED BY EVOFIT OR USE OF EQUIPMENT I PROVIDE.

PHYSICIAN APPROVAL:

I understand that it is voluntary to participate in the training and other physical activities and services offered by EvoFit, and accept all risks related to the training and its facilities. I represent that I am not aware of any medical or physical condition that would prevent me from participating in the training or from using equipment or facilities which pose a serious health risk to me. I further acknowledge and agree that I am not obligated to participate in any training that I do not wish to participate in. I will inform EvoFit immediately if I do not wish to participate in any specific training.

NAME AND LIKENESS RELEASE:

I hereby grant EvoFit permission to use my likeness in a photograph, video, or other digital media (“photo”) in all its publications, including web-based publications, without payment or other consideration. I understand and agree that all photos will become the property of EvoFit and will not be returned. In addition, I waive any right to inspect or approve the finished product wherein my likeness appears. ACKNOWLEDGEMENT OF UNDERSTANDING: By signing this Agreement, the Client acknowledges reading, understanding, and agreeing with all terms and conditions within this Membership Agreement and Liability Waiver Agreement. This Agreement constitutes an unconventional release of liability to the greatest extent of the law. The entire agreement of the parties and no other agreement or understanding exists between Client and EvoFit. EvoFit has made no express or implied warranties or representations other than those specifically set forth in this Agreement.
