By signing this document, I hereby acknowledge that I have voluntarily chosen to participate in a program of intense physical exercise. Quad4 Inc. strongly recommends that I consult a doctor prior to commencing classes. I acknowledge and understand that the activities I will participate in could be dangerous and could cause bodily harm and I sign this waiver and release with the knowledge of the possibility of injury. I acknowledge that I am fully informed of the strenuous nature of the exercise/spin classes and the possibility of adverse physiological occurrences including but not limited to, abnormal blood pressure, fainting, heart attack, or death.

DISCLAIMER CLAUSE

I accept that QUAD4 Inc., and their officers, directors, employees, volunteers, members, agents and representatives (collectively referred to as “QUAD4”) are not responsible for any injury, loss or damage of any kind sustained by me or any other person while participating in any activity or event associated with QUAD4, including injury loss or damage which might be caused by the negligence of QUAD4.

WAIVER AND RELEASE

I agree that if the I engage in any physical exercise or activity, or use any QUAD4 facility or equipment, on QUAD4’s facilities and premises, or an event hosted by QUAD4, I do so at my own risk. I agree that I am voluntarily participating in these activities and using these facilities and premises and assume all risk of injury, illness, damage or loss to myself or my property that might result, including, without limitation, any injury, any loss or theft of personal property. I agree on behalf of myself (and my personal representatives, heirs, executors, administrators, agents and assigns) to release and discharge QUAD4 (and its nominees, associates, affiliates, employees, agents, representatives, successors and assigns) from any and all claims, or causes of action (known or unknown) arising out of the negligence of QUAD4. I hereby waive any right that I may have to bring a legal action to assert a claim against QUAD4 for its negligence or any other cause of action, including breach of contract, breach of any other statutory or other duty of care, including any duty of care under the Occupier’s Liability Act,

R.S.O. 1990, Chapter O.2., on the part of QUAD4. This waiver and release of liability includes, without limitation, any injuries which may occur as a result of (a) my use of any equipment or facilities which may malfunction or break, (b) improper maintenance by QUAD4 of any equipment or facilities, (c) negligent instruction or supervision by QUAD4, and (d) my slipping and falling while on QUAD4’s premises.

HOLD HARMLESS AND INDEMNITY

I agree to hold QUAD4 harmless and indemnify QUAD4 from any liability for any damage to the personal property of, or personal injury to, any third party resulting from my participation in activities or events associated with QUAD4; and from any claims, demands, actions and costs which might arise out of my participation, even if such claims, demands, actions and costs may have been caused by the negligence of QUAD4.

ACKNOWLEDGEMENT

The information set forth above is correct. I (we) have read and understand both sides of this agreement and the Rules and Regulations and will accept and abide by the agreement and the Rules now in effect, or as may be hereafter amended. I acknowledge that I have carefully read this entire agreement, that I have executed it voluntarily, and that this agreement is binding on me, and will continue to be binding on me, my heirs, executors, administrators and representatives, in the event of my death or incapacity, or despite any changes in my role as a participant.
