WAIVER OF LIABILITY

I understand and acknowledge that I am participating in fitness classes offered by Yoga Fever, LLC (“FeverYCS”). Participation in this instruction and training is voluntary. I recognize that fitness involves physical exertion, which may cause physical injury, and I assume all risk associated with it including Covid 19.

I understand that it is my responsibility to consult with a physician prior to and regarding my participation in the classes and other programs provided by Yoga Fever.

I represent and warrant that I am physically fit and I have no condition that would prevent my participation. (Fitness classes at Fever are not always recommended for pregnant women. If you are pregnant and choose to participate, please notify the instructor before each class.)

I agree to assume full responsibility and hold harmless Fever and its agents and employees from any cost, damage, injury, Covid 19 or any other claim resulting from any participation in or instructional training provided at these yoga classes or related programs.

I, for myself and my heirs or assigns, agree to hold Yoga Fever harmless, and I agree to indemnify Fever for any costs or expense Yoga Fever may incur as a result of any liability or claim described above.

PHOTO/VIDEO RELEASE

I hereby authorize Fever, its representatives and employees the right to take photographs and videos of me and/or any undersigned minor children. I authorize Fever, its assigns and transferees to copyright, use, and publish the same in print and/or electronically.

I agree that Fever may use such photographs and videos of me and/or any undersigned minor children with or without our names and for any lawful purpose, including for example such purposes as publicity, illustration, advertising, and Web content.

I hereby release and hold harmless Fever from any reasonable expectation of privacy or confidentiality associated with the images specified above and attest that I am the parent or legal guardian of any minor children listed below and that I have the authority to authorize Fever to use their photographs, videos and names.

I further acknowledge that participation is voluntary and that neither any minor children nor I will receive financial compensation of any type associated with the taking or publication of these photographs and videos or participation in Fever marketing materials or other Fever publications. I acknowledge and agree that publication of said photographs and videos confers no rights of ownership or royalties whatsoever.

I hereby release Fever, its contractors, its employees, and any third parties involved in the creation or publication of marketing materials, from liability for any claims by me or any third party in connection with my participation and/or the participation of any undersigned minor children.
