Terms and Conditions

In consideration of my being permitted to participate in cycling classes and/or other fitness training of any nature or kind offered by 6ix Cycle Spin Studios Corp., including (without limitation) involving the use of any stationary bicycles, weights or other training equipment (collectively, the “Fitness Activities”), I hereby agree to the following waivers and releases.

1. I (on behalf of myself, and my heirs, executors, administrators or other persons who may claim on my behalf), hereby waive, release and forever discharge, 6ix Cycle, Spin Studio Corp. and its owners, manager(s), directors, officers, employees, instructors, and each of their legal representatives, heirs, executors, successors and assigns (each a “Releasee” and collectively, the “Releasees”) from any and all liability, claims, demands, actions or causes of action resulting from personal injury, death, damage to property or loss of any kind resulting from my participation in any Fitness Activities, arising from any cause whatsoever, including (without limitation) negligence or the breach of any statutory or other duty of care on the part of any of the Releasees. I acknowledge and accept sole responsibility for all hazards and risks to me and my property associated with or related to my participation in the Fitness Activities and for any damage or injury that I may cause to others.

BY SIGNING THIS RELEASE AND WAIVER AND PARTICIPATING IN ANY FITNESS ACTIVITIES, I HEREBY REPRESENT AND WARRANT TO 6IX CYCLE SPIN STUDIOS CORP. AND EACH OF THE OTHER RELEASEES THAT I AM VOLUNTARILY PARTICIPATING IN, AND HAVE THE SUFFICIENT LEVEL OF PHYSICAL FITNESS TO PARTICIPATE IN, THE FITNESS ACTIVITIES, AND ACKNOWLEDGE AND AGREE THAT I AM AWARE AND HAVE BEEN ADVISED THAT ALL SUCH FITNESS ACTIVITIES ARE OF A STRENUOUS LEVEL.

2. This agreement and any rights, duties and obligations as between the parties to this agreement shall be governed by and interpreted in accordance with the laws of the Province of Ontario, and shall be binding on each of my legal representatives, heirs, executors, successors and assigns, and shall ensure to the benefit of each of the Releasees.

3. In entering into this agreement, I further represent that I am at least age 18 years or older and acknowledge and agree that I am not relying on any oral or written representations made by the Releasees.

4. None of the Releasees shall be responsible for any loss, damage or theft to any of my personal belongings brought onto 6ix Cycle Spin Studios Corp.'s premises.

5. I am aware that by signing this agreement I am waiving certain legal rights which I or my heirs, executors and personal representatives may have against the Releasees.
