Terms and Conditions

By attending classes or an event sponsored/supported by Fit FRIENDzy Studios, and/or by using our babysitting services, and/or by using any other services provided, you confirm you have medical approval to do so, you comply with all COVID-19 guidelines, you confirm you are aware pictures or videos of the studio/students may be used for social media and other purposes (or have contacted [email protected] to express otherwise), and you have released all rights whatsoever of taking legal action against us or anyone supporting us.

 

You accept that we do our best to maintain a favorable environment and you are equally responsible in helping us do so. You also agree to read and follow the policies on http://bethefitfriend.com and that if you don’t, you may be asked to leave the studio or event with no rights to pursue legal action.

 

 

This Waiver and General Release (referred to as “Waiver”), will be signed prior to participation in any activity at, or supported by, Fit FRIENDzy Studios (“Studio”) as outlined herein. The Waiver is for and in consideration of the participation of (the “Participant”) in all classes, jams, events, babysitting, parties and all other related activities (collectively, the “Activities”) at the Studio. Participant hereby indemnifies, releases from liability and holds harmless the Studio, and its respective members, managers, employees, contractors, affiliated companies and individuals, principles, subordinates, officers, directors, representatives, guests and invitees (collectively, the “Released Parties”) from all loss, costs and/or damages due to accident, injury, illness death to person(s) and/or property, or other consequences suffered or incurred by Participant or any other person resulting directly or indirectly from Participant’s participation in any of the Activities or use of the facilities, parking areas or services related to any of the Activities, whether foreseen or unforeseen, known or unknown, now and forever.

The term “Participant” shall include the Participant’s spouse, partner, parent, other family members, guardians, legal representatives, legatees, heirs, successors, assigns and/or insurance companies (collectively, the “Releasing Parties”). Participant acknowledges that each of the Releasing Parties shall be bound by the terms, conditions and limitations of the Waiver as if he or she were a signatory hereto. Participant may sign a supplementary form (titled “Babysitting Waiver and General Release” referred to as “Babysitting Waiver” herein) if they utilize the Babysitting services offered at the Studio. The Babysitting Waiver is an additional and mainly informational release; The Waiver takes precedence and governs babysitting services.

PARTICIPANT IS AWARE OF THE POTENTIAL DANGERS INHERENT IN ENGAGING IN ANY OF THE ACTIVITIES, AND THAT THIS IS A WAIVER AND GENERAL RELEASE OF ALL LIABILITY. PARTICIPANT EXPRESSLY ASSUMES ALL RISK TO HIM/HERSELF AND/OR OTHERS, AND SHALL BE SOLELY RESPONSIBLE FOR ALL LOSS, COSTS AND DAMAGES RELATED TO PARTICIPATION IN THE ACTIVITIES (OR ANY OF THEM), INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES. PARTICIPANT EXPRESSLY WAIVES ANY RIGHTS TO PURSUE ANY LEGAL CLAIMS OR ACTIONS AND HEREBY RELEASES AND INDEMNIFIES ALL OF THE RELEASED PARTIES FROM LIABILITY AS AFORESAID. PARTICIPANT CONFIRMS THEY HAVE MEDICAL APPROVAL TO PARTICIPATE IN ALL ACTIVITIES AT OR PERTAINING TO THE STUDIO.

 

PARTICIPANT IS AWARE OF AND AGREES TO COMPLY WITH THE FOLLOWING COVID-19 GUIDELINES FOR WHICH PARTICIPANT IS RESPONSIBLE:

 

If a client shows any symptoms of Covid-19 or tests positive for Covid-19 within 14 days of attending the studio, the client should immediately contact

A staff member of Fit FRIENDzy Studios will review whom the client has had contact with at the studio in the prior 14 days leading up to going into isolation from the studio. This will include all clients and team members that the team member has had close contact with (close contact being within 6 feet for at least 5 minutes) as well as what areas of the studio and equipment the team member had touched or been in.

If you have been in close contact (per the above definition) with an affected client who tests positive for Covid-19 within their isolation period, you will be notified via email and phone call. Per the CDC guidelines, remain in isolation for 14 days and self monitor for symptoms. Seek medical attention should you develop any symptoms.

We are implementing policies to protect all team members and client’s health details and conditions. When notifying people who have had close contact with an affected team member, the identity and condition of the client will not be shared.

All clients who show symptoms may not re-enter the studio until at least 72 hours have passed since the resolution of fever without the use of fever-reducing medications, and improvement in respiratory symptoms such as shortness of breath or cough, and at least 7 days have passed since symptoms began.  A doctor's note will be required for reentry.

 

All clients who do not meet the travel guidelines as outlined on https://www.mass.gov/info-details/covid-19-travel-order must REFRAIN FROM ATTENDING STUDIO CLASSES OR EVENTS until they do.

All clients should practice social distancing by deliberately increasing the physical space between you and other people to at least six feet wherever possible.

 

FINALLY:

Participant agrees to read the policies and terms set forth on https://www.bethefitfriend.com (also available in print upon request) and accepts that if not followed, Participant may be asked to leave the Studio or any related Activities. In such an event, no legal actions will be taken by the Studio or Participant.

Participant agrees that this Waiver shall be governed by the laws of the Commonwealth of Massachusetts and that this is Participant’s free act and deed.
