Terms and Conditions
Because physical exercise can be strenuous and subject to risk of serious injury, Sportset Health & Fitness Club and it’s subsidiaries: Come Together Yoga Studio, RVC Ryde and Sportset Kids, urges you to obtain a physical examination from a doctor before using any exercise equipment or participating in any exercise activity.
You (each client, guest, and all participating family members) agree that if you engage in any physical exercise or activity, or use any gym amenity on the premises or off premises, including any sponsored gym event, you do so entirely at your own risk. Any recommendation for changes in diet, including the use of food supplements, weight reduction and/or body building enhancement products are entirely your responsibility, and you should consult a physician prior to under- going any dietary or food supplement changes.
You agree that you are voluntarily participating in these activities and use of these facilities and premises and assume all risks of injury, illness, or death. We are also not responsible for any loss of your personal property. This waiver and release of liability includes, without limitation, all injuries which may occur as a result of:
1) your use of all amenities and equipment in the facility and your participation in any activity, class, program, personal training or instruction;,
2) the sudden and unforeseen malfunctioning of any equipment;
3) our instruction, training, supervision, or dietary recommendations; and4) your slipping and/or falling while in the building, or on the premises, including adjacent sidewalks and parking areas.
You acknowledge that you have carefully read this “waiver and release” and fully understand that it is a release of liability. You expressly agree to release and discharge the gym, and all affiliates, employees, agents, representatives, successors, or assigns, from any and all claims or causes of action and you agree to voluntarily give up or waive any right that you may otherwise have to bring a legal action against the gym for personal injury or property damage.
To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence on the part of the facility, its agents, and employees. If any portion of this release from liability shall be deemed by a court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect, and the offending provision of provisions severed here from.
Media Release and Consent
By signing this agreement, you acknowledge and agree that Sportset Health & Fitness Club and its subsidiaries, including but not limited to Come Together Yoga Studio, RVC Ryde, and Sportset Kids, may take photographs, video recordings, or other media (""Media"") of you while you are on the premises or participating in any activity, class, program, or event, whether on or off-site.
You hereby irrevocably grant Sportset Health & Fitness Club, its subsidiaries, and its agents, representatives, and assigns the unrestricted right, without compensation or notice, to use, reproduce, display, distribute, publish, or otherwise utilize such Media in any form, whether now known or hereafter devised, including but not limited to promotional materials, advertising, website content, social media, newsletters, and other marketing channels.
You expressly release and discharge Sportset Health & Fitness Club and its subsidiaries from any and all claims, demands, or causes of action that you may have, including but not limited to claims for invasion of privacy, right of publicity, or defamation, arising from the use of the Media as described above.
Furthermore, you waive any right to inspect or approve the Media or any accompanying text or captions used in connection with the Media. You also waive any rights to royalties or other compensation arising from or related to the use of the Media.
You acknowledge and agree that Sportset Health & Fitness Club shall retain exclusive ownership of all rights to the Media and that the Media may be edited, cropped, altered, or otherwise modified at the sole discretion of Sportset Health & Fitness Club.
Acknowledgment and Acceptance
By signing this release, and checking the box I acknowledge that I understand its content and that this release cannot be modified orally. It is my express intent that this Waiver and Hold Harmless Agreement shall bind any assigns and representatives, and shall be deemed as a RELEASE, WAIVER, DISCHARGE, AND COVENANT NOT TO SUE the above named RELEASES. This Agreement and the provisions contained herein shall be construed, interpreted and controlled according to the laws of the State of New York. I HEREBY KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A JURY TRIAL OF ANY DISPUTE ARISING IN CONNECTION WITH THIS AGREEMENT. I ACKNOWLEDGE THAT THIS WAIVER WAS EXPRESSLY NEGOTIATED AND IS A MATERIAL INDUCEMENT THE PERMISSION GRANTED BY RELEASES TO BE ON PREMISES AND PARTICIPATE IN THE ACTIVITIES.
IN SIGNING THIS AGREEMENT, I ACKNOWLEDGE AND REPRESENT THAT I have read the foregoing
Waiver of Liability and Hold Harmless Agreement including the Media Release and Consent, understand it and sign it voluntarily as my own free act and deed; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this Agreement for full, adequate and complete consideration fully intending to be bound by same.
IN WITNESS WHEREOF, I have signed this Waiver and Agreement under seal on this __ day of ________, 2025.
