Terms and Conditions
This Release is by the party signing below (referred to, in context, as “you”, “I”, “me”, or “your”), and is given to ET Ventures LLC, doing business in Virginia as VORTEX CYCLE, its insurers, affiliates, divisions, employees, owners, officers and directors, agents, associates, sponsors, legal representatives, successors and assigns, those for whom they are acting and those acting with their authority and permission (collectively as “Vortex Cycle parties”), including the owners and operators of and in the facilities in which the Vortex Cycle classes, activities and programs, and its equipment are held and located and in which its associated operating and production and recording activities are also performed (collectively and individually, “Programs”). I agree and contract on my behalf and on behalf of and for my spouse, legal representatives, heirs, executors, administrators, successors, assigns and subrogors.
I, being of lawful age (or, in the case of a minor, through my parent or guardian who is signed below), warrant and represent that I have no disability, impairment or ailment that is or will be detrimental to my health or safety or to the health or safety of other participants or is otherwise preventing me from engaging in any form of exercise or activity. As a reasonable practice before involvement in Program, generally for health and fitness in any respect and especially if I am in doubt about any part of my health, my fitness training or recreation, I will consult my personal physician before participating. I will consult my personal physician prior to undergoing any dietary or food supplement changes or using any of the information I may gain and before undertaking any weight reduction steps. Vortex Cycle uses (a) amplified microphones for its employees, staff and instructors and amplified music, including at times, high volume music or music with labeling as “explicit” or with a “parental advisory”, and (b) lighting, including at times, theatrical or dynamic lighting effects, and programs as a part of and in its Programs. I acknowledge that in using the facilities, participating in classes, activities and programs, and the equipment, I do so entirely at my own risk and in doing so agree that there may be the use of such music and lighting and I consent to such uses. A very small percentage of individuals may experience epileptic seizures or blackouts when exposed to certain light patterns or flashing lights and exposure to certain patterns or backgrounds may trigger epileptic seizures or blackouts in these individuals. These conditions may trigger previously undetected epileptic symptoms or seizures in persons who have no history of prior seizures or epilepsy. If you, or anyone in your family has an epileptic condition or has had seizures of any kind, consult your physician. I agree to be solely responsible for any activities I participate in and I assume the risk of injury, including permanent disability or death. I understand that Vortex Cycle parties are not responsible for my actions or the actions of other participants or guests.
I, being of lawful age (or, in the case of a minor, through my parent or guardian), in consideration of being permitted to participate in the Programs, and for other good and valuable consideration herein acknowledged as received and sufficient, for myself, my spouse, legal representatives, heirs, executors, administrators, successors, assigns and subrogors, do consent not to sue, release, waive and forever discharge Vortex Cycle parties from any and all liability for any and all losses and damages of any type or kind, and from any and all claims, suits, demands, actions or rights of actions, of whatever kind, either in law or equity, arising from or by reason of death, personal injury known or unknown, or property damage resulting from any incident which may occur during my presence at the Programs and/or participation in any official or unofficial activity, event or competition whether caused in whole or in part by the Vortex Cycle parties or any other person or thing at the Programs while I am present. I understand and agree that Vortex Cycle parties are not responsible for any injury or property damage arising out of the Programs, even if caused by their ordinary negligence. I, and my parent or guardian in the event I am a minor, agree to fully indemnify, defend and hold Vortex Cycle parties harmless for all actions or omissions by me while at the Programs. I assume full responsibility for the risk of bodily injury, death or property damage due to the negligence of the Vortex Cycle parties or any other third party or thing while at the Programs, and while involved, training, working, competing, spectating, or for any other purpose at the Programs or traveling to or from the Programs. I fully and completely release the Vortex Cycle parties of and from all liability to me and to anyone or any entity claiming by, through or under me, by subrogation or otherwise, it being my intent to fully waive and release all subrogation rights. There is no limit to these indemnities.
I, being of lawful age, (or, in the case of a minor, through my parent or guardian), grant to Vortex Cycle (""Publisher""), its affiliates, divisions and the owners and operators of the facilities in which the Programs are held and its and their employees, owners, officers and directors, agents, associates, sponsors, legal representatives, successors and assigns, those for whom they are acting and those acting with their authority and permission (collectively as “Publisher’s Affiliates”) including without limitation advertising, promotion and production agencies, and their respective assigns, the absolute right and permission to make, reproduce, broadcast or otherwise use my name and likeness, any photograph, films, videos, recordings, or other depictions or images in whatever form or media of me in connection with Programs and/or other information or materials provided by me or others on my behalf in connection with these Programs throughout the universe and in any and all advertising and promotion materials, in any manner or media whatsoever for purposes of art, advertising, editorial, trade or promotion or any other purpose whatsoever. The rights herein granted to Publisher and Publisher’s Affiliates shall also accrue to those that may hereafter acquire these rights from them. It is acknowledged and agreed that neither I or my parent or guardian, shall have a right of approval, a claim to any compensation or a claim arising out of the use, alteration or distortion of my name, photograph, likeness or other information or materials provided.
I HAVE CAREFULLY READ THIS DOCUMENT AND UNDERSTAND ALL OF ITS TERMS. I EXECUTE THE SAME VOLUNTARILY AND WITH FULL KNOWLEDGE OF ITS CONTENT AND SIGNIFICANCE INCLUDING THAT BY SIGNING IT I GIVE UP MANY LEGAL RIGHTS THAT MAY OTHERWISE BE AVAILABLE. I AGREE THAT THIS CONSTITUTES THE ENTIRE AGREEMENT BETWEEN ME AND THE OTHERS HEREIN NOTED WITH REGARD TO ITS TERMS AND SHALL CONTINUE IN FULL FORCE AND BE APPLICABLE TO ANY AND ALL ACTIVITIES RELEASOR ATTENDS WHILE AT THE PROGRAMS.
