Terms and Conditions

This form is valid only for the the individual registering for the Ultimate Workout. If the prospective client is under the age of 18, then a parent or guardian must give written consent. The client hereby acknowledges to follow our rules and regulations:

I understand that violation of the rules may cause my admission to the club to be immediately revoked or terminated at the discretion of the business. In the event of a violation of the rules and regulations of the club, client will be considered in default of the terms and will forfeit all gym privileges. Business reserves the right to make additional rules and regulations as they deem necessary at their sole discretion. ANY AMOUNT PURCHASED IS ABSOLUTELY NON-REFUNDABLE UNDER ANY CIRCUMSTANCES.

Liability Waiver: It is expressly agreed that all use of the fitness facilities shall be undertaken at signatory’s risk. It is further agreed that NEITHER THE BUSINESS NOR TRAINERS SHALL BE LIABLE for any injuries or damage to signatory or his or her guests, nor the property of any signatory or his or her guest, nor the subject of any claim, demand, injury or damage whatsoever. The business or individual trainers are not responsible for damages resulting from acts of active or passive negligence on the part of the business or individual trainers, its successors or assigns or officers and agents. It is specifically agreed the business or trainers shall not be responsible or liable to the signatory or his/her guests for articles damaged, lost, or stolen on the gym premises, including their automobiles and the contents held therein. It is also agreed that any damages to the club facility or property, or to the property of another client by another client or his/her guests is the sole responsibility of the offending client. Client agrees that he/she is responsible for any damages caused by client to the facility and equipment, and for personal injury or property damage caused by client to any other client, guest, or to the property of either. Client further agrees to indemnify the business of any loss caused by client for which the business or trainer is accused or held liable, including reasonable attorney fees.

Media Release: As a client of The Ultimate Workout built by Todd Smith, by signing this document you consent to the use of your image in social media and promotional photo and/or video advertising for said businesses without additional prior notification. This applies to videos or photos taken during the session by either staff, third parties hired by said staff, and media images taken by other consenting clients. Personal testimonies or photos and videos taken outside of the duration of the session will be done so on a voluntary basis and are not required to be permitted by this agreement.

Class Cancellation Policy: When booking your classes, there is a 10-hour cancellation policy. If you cancel within 10 hours, your reservation will count as an attended class and be deducted from your available classes for the week. If you are an Ultimate Workout member, you will be billed $5 per no-show.
