Terms and Conditions

1. That I am participating in exercise, personal training, or similar activities (hereinafter “Program”) offered by, Amplifly LLC, during which I will receive training and instruction related to physical fitness, health, and related matters. I recognize and understand that these activities will involve physical exertion that may be strenuous and may cause physical injury, and I am fully aware of the risks and hazards involved.

2. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in the Program. I represent and warrant that I am physically fit enough to participate, and have no medical condition that would prevent my full participation in the Program.

3. In consideration of being permitted to participate in the Program, I agree to assume full responsibility for any risks, injuries, or damages, known or unknown, which I might incur as a result of participating in the Program.

4. In further consideration of being permitted to participate in the Program, I knowingly, voluntarily and expressly waive any claim I may have against Amplifly, LLC, and its heirs and assigns, for injury or damages I may sustain as a result of participating in the Program.

5. I hereby grant and authorize Amplifly: RIDE.LIFT.FLOW the right to take, edit, alter, copy, exhibit, publish, distribute and make use of any and all pictures or video taken of me by Amplifly to be used in and/or for legally promotional materials including but not limited to, newsletters, flyers, posters, brochures, advertisements, fundraising letters, annual reports, press kits, websites, social networking sites and other print and digital communications, without payment or any other consideration. This authorization extends to all languages, media, formats, and markets now known or hereafter devised. This authorization shall continue indefinitely, unless I otherwise revoke said authorization in writing.

I understand and agree that these materials shall become the property of Amplifly: RIDE.LIFT.FLOW and will not be returned.

6. I, my heirs or legal representatives forever release, waive, discharge and covenant not to sue Amplifly, LLC, for any injury or death caused by their negligence or other acts.

7. This Agreement is to be governed by the laws of the State of North Carolina, and the venue for any dispute arising hereunder shall be New Hanover County, North Carolina. Should any clause or provision of this Agreement be found illegal, invalid or unenforceable under present or future laws, the remainder of this Agreement shall not be affected thereby.

PHOTO AND VIDEO USE RELEASE,

I grant Amplifly LLC, the right to take, edit, alter, copy, exhibit, publish, distribute, and make use of any and all pictures or video taken of me by Amplifly LLC to be used in and/or for legally promotional materials including but not limited to, newsletters, flyers, posters, brochures, advertisements, fundraising letters, annual reports, press kits, websites, social networking sites, online training videos, and other print and digital communications, without payment or any other consideration, This authorization extends to all languages, media, formats, and markets now known or hereafter devised. I understand and agree that these materials shall become the property of Amplifly LLC and will not be returned.

(For classes that will be live filmed: Amplifly LLC will provide areas of the classroom that will not be visible on camera, or video for members wishing to not be seen)

COVID-19

Acknowledgement and Assumption of the Risk Relating to COVID-19: I understand that Amplifly LLC has put in place preventative measures to reduce the spread of COVID-19; however, Amplifly LLC cannot guarantee that I or members of my household will not become infected with COVID-19. By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I or members of my household may be exposed to or infected by COVID-19 while on the premises of Amplifly LLC and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at Amplifly LLC may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Amplifly LLC employees, independent personal trainers, and other individuals using the premises. [With respect to COVID-19 I expressly acknowledge and agree that I am responsible for providing my own personal protective equipment and to follow CDC guidelines on safe social distancing. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks.]

I have read the above release and waiver of liability and fully understand its contents and voluntarily agree to the terms and conditions stated above.
