By signing up for a Fhitting Room® class, you acknowledge that you have voluntarily chosen to participate in a program of intense physical exercise. You further acknowledge that Fhitting Room® strongly recommends that you consult with your physician prior to commencing any classes. You acknowledge that you are fully informed of the strenuous nature of this exercise program and the possibility of adverse physiological occurrences including, but not limited to, abnormal blood pressure, fainting, heart attack or death. You assume all risk for your health and well being, and fully release and hold harmless for any responsibility, cost or damages The Fhitting Room Holding Company LLC d/b/a The Fhitting Room and all its wholly owned subsidiaries, its trainers, members and employees. You acknowledge that your agreement to this release applies to each time you visit The Fhitting Room®. You hereby acknowledge that you, and any minor under your care, have voluntarily chosen to participate. You assume all risk for your health and well being, and that of any minor under your care, and fully release The Fhitting Room Holding Company LLC d/b/a The Fhitting Room and all its wholly owned subsidiaries from all liability.

PERMISSIONS

I hereby grant permission to The Fhitting Room, and its employees, agents and representatives to photograph my image, likeness, or depiction. I hereby further grant permission to The Fhitting Room to edit, crop, or retouch such photographs, and waive any right to inspect the final photographs. I hereby consent to and permit photographs of me to be used by The Fhitting Room for advertising and promotional purposes in any medium, including print and electronic. I understand that The Fhitting Room may use such photographs with or without associating names thereto. I further waive any claim for compensation of any kind as a result of The Fhitting Room's use or publication of photographs of me. I hereby fully and forever discharge and release The Fhitting Room from any claim for damages of any kind arising out of the use or publication of any such photographs.

PURCHASE & REFUND POLICY

Classes and trainer assignments are subject to change. Pricing is subject to change without notice. All class packages are non-transferable and non-refundable; there are no exceptions. Single classes expire 30 days from date of purchase. 5 class series packages expire 3 months from date of purchase. 10 class series packages expire 6 months from the date of purchase. 20 class series packages expire 1 year from the date of purchase. Supercharged Monthly packages expire 30 days from date of purchase. Class participants must be 16 years of age or older unless otherwise noted. Unused retail merchandise may be returned for a refund or exchanged within 7 days of purchase. Online purchases that are unworn and unwashed with original tags can be returned for a $10 restocking fee. We do not provide return shipping labels.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

Fhitting Room Services may include certain services that may be available via your mobile phone, including but not limited to (i) the ability to book and/or purchase Fhitting Room class packages via your mobile phone, (ii) the ability to receive and reply to Fhitting Room messages, (iii) the ability to browse Fhitting Room from your mobile phone and (iv) the ability to access certain Fhitting Room features through a mobile application you have downloaded and installed on your mobile phone (collectively the “Mobile Services”). We do not charge for these Mobile Services. However, your carrier’s normal messaging, data and other rates and fees will still apply. You should check with your carrier to find out what plans are available and how much they cost. In addition, downloading, installing, or using certain Mobile Services may be prohibited or restricted by your carrier, and not all Mobile Services may work with all carriers or devices. Therefore, you should check with your carrier to find out if the Mobile Services are available for your mobile devices, and what restrictions, if any, may be applicable to your use of such Mobile Services. By using the Mobile Services, you agree that we may communicate with you regarding Fhitting Room and other entities by SMS, MMS, text message or other electronic means to your mobile device and that certain information about your usage of the Mobile Services may be communicated to us.

When you sign up for member Services, you will also be asked to choose a password. You are entirely responsible for maintaining the confidentiality of your password. You agree not to use the account, username, or password of another member at any time or to disclose your password to any third party. You agree to notify Fhitting Room immediately if you suspect any unauthorized use of your account or access to your password. You are solely responsible for any and all use of your account.

CCTV

CCTV is installed at some of our sites, to monitor building security and assist in crime prevention and detection.

We operate our CCTV in accordance with the guidance issued by the local data protection authority. Fhitting Room collects this data as part of its role as a service provider to you, and to ensure the health and safety of our staff and visitors to our sites.

We will not hold images for longer than necessary and will dispose of them securely.
