AOK! Fitness Liability Waiver Required Rev.5-20

Please Read & Understand

By checking the box, I agree that AOK! Fitness or its staff is in no way responsible for the safekeeping of my personal belongings while I attend class. I give my consent to participate in a fitness class, Livestream/Video Workout or training session as conducted by AOK! Fitness, LTD, their instructors/trainers. I recognize that exercise carries some risks to the musculoskeletal system (sprains, strains) and the cardio respiratory system (dizziness, discomfort in breathing, heart attack). I hereby certify that I know of no medical problem (or pregnancy) except those noted, that would increase my risk of illness and injury as a result of participating in a regular exercise program. Furthermore by checking the box, I understand that this cost is non-refundable if unable to participate. I am personally responsible for my actions and my child or children’s actions with AOK! Fitness, Ltd while attending this event, class or Livestream/Video session and I waive responsibility if I (we) should incur any injury as a result of my (our) negligence. I understand that classes, whether live or In-studio at AOK! Fitness, LTD may be physically strenuous and I voluntarily participate in them with full knowledge that there is risk of personal injury, property loss or death. I agree that neither I, my heirs, assignees nor legal representatives will sue or make any other claims of any kind whatsoever against AOK! Fitness, LTD it’s owners, staff, instructors, trainers or its members for any personal injury, property damage/loss, or wrongful death, whether caused by negligence or otherwise.

COVID-19 RELEASE
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to person contact. As a result, federal, state, and local governments and federal and state health agencies
Recommend social distancing and have, in many locations, prohibited the congregation of groups of people.
AOK! Fitness, LTD has put in place preventative measures to reduce the spread of COVID-19; however, AOK! Fitness, LTD and its INSTRUCTORS/STAFF cannot guarantee that you will not become infected with COVID-19. Further, attending AOK! Fitness, LTD could increase your risk and your child(ren)’s risk of contracting COVID-19.

By CHECK THE BOX YOU are AGREE & acknowledge the contagious nature
of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 by attending AOK! Fitness, LTD and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at AOK! Fitness, LTD may result from the actions, omissions, or negligence of me and others, including, but not limited to, AOK! Fitness, LTD Instructors, staff, clients and class participants. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with my attendance and participation in classes and private sessions at AOK! Fitness, LTD (“Claims”).

COVID-19 RELEASE continued
I hereby release, covenant not to sue, discharge, and hold harmless AOK! Fitness, LTD, its owner, instructors. staff, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of AOK! Fitness, LTD its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any of AOK!’s programs

I voluntarily agree to forgo participation and attendance at AOK! Fitness, LTD and its location at 12381 Pearl Rd., Strongsville OH 44136 or any event held by AOK! Fitness, LTD outside of its location if I have any of the
following confirmed COVID-19 symptoms:
• Cough
• Shortness of breath or difficulty breathing
• Fever
• Chills
• Muscle pain
• Sore throat
• New loss of taste or smell
This list is not all possible symptoms. Other less common symptoms have been reported, including gastrointestinal symptoms like nausea, vomiting, or diarrhea.
I voluntarily agree to notify and inform AOK! Fitness, LTD Owner/Management if I have tested positive for COVID-19 after attending and participating in class at AOK! Fitness, LTD. I acknowledge that my identity will remain confidential after notifying AOK! Fitness, LTD of a positive COVID-19 test.

MEDIA RELEASE
I hereby give permission to AOK! Fitness, LTD & its affiliates to LIVESTREAM, interview, photograph and/or videotape me. It is my understanding that these Livestream, photographs/interviews/videos or portions thereof will be used for public & member viewing & used through AOK! Fitness, LTD & its social media outlets. Notice will be given so that you can decline or step out of the camera shot. Should I agree to participate in these projects, I understand I do so without financial remuneration, & I understand that this releases AOK! Fitness, LTD from any future claims, as well as from any liability arising from the use of the said Livestream/photograph/interview/videotape. I understand that I am not permitted to photograph or videotape while participating in a class at AOK! Fitness, LTD without permission from its Owner/Management
