Heathers Gym LLC - Release of Liability

1. In consideration of participation in the fitness activities and programs of Heather's Gym LLC, its facilities, equipment, and services, in addition to the payment of any fee or charge or as a party guest, I do hereby forever waive, release and discharge Heather's Gym LLC and its officers, agents, employees, instructors, representatives, executors and all others acting on its behalf from any and all claims or liabilities for injuries or damages to my person, my children who participate in HG programs/classes/parties or who may be on site in the waiting area, and/or to my property. This includes any claims caused by the negligent act or omission of any of those mentioned or others acting on their behalf, arising out of or connected with my participation in any activities, programs or services of Heather's Gym LLC or the use of any equipment at any location, including injuries or damage that may arise from online ""virtual"" training provided or recommended by Heather's Gym LLC. 

2. I understand that fitness activities, including the use of equipment, is a potentially hazardous activity. I am also aware that fitness activities involve a risk of injury, including a remote risk of death or serious disability, and that I am voluntarily participating in (and/or allowing my minor child to participate) in these activities, including injuries or damage that may arise from online ""virtual"" training, and the use of any equipment with full knowledge, understanding and appreciation of the dangers involved. I hereby agree to expressly assume and accept any and all risks of injury or death.

3. I do hereby further declare myself (and/or my participating minor child) to be physically sound and suffering from no condition, impairment, disease, infirmity or other illness that would prevent my (and/or my minor child's) participation in these activities or use of equipment. I do hereby acknowledge that I have been informed of the need for a physician’s approval for my and/or my minor child's participation in exercise activities, programs and the use of exercise equipment. I acknowledge that either I (and/or my participating child) have had a physical examination and have been given a physician’s permission to participate or I have decided to participate in exercise activities, programs and the use of equipment without the approval of my physician and do hereby assume all responsibility for my participation (and/or my minor child's) participation in said activities, including online ""virtual"" training, all programs and use of equipment.

4. I agree that Heather’s Gym LLC may use video or photographs of myself (and/or my minor children) in their marketing for advertising.
