I am in good physical condition and able to use the equipment and participate in the programs made available by BLAST, with the understanding that BLAST personnel are not licensed to and have no special expertise in diagnosing, examining, treating, or otherwise assisting with any medical condition or the effect of the use of equipment or participation in programs with respect thereto. 2. I understand that the use of the equipment and the participation in the programs made available by BLAST are at my sole risk, understanding the risk of injury and other accidents, and hereby agree to assume the full risks thereof, foreseen and unforeseen. 3. I shall be responsible and pay for all damage, cost, loss and expense for the property of BLAST caused by myself and/or my guests. 4. BLAST and its owners, and/or any affiliated companies and their respective owners, officers, directors, agents, employees, and attorneys (collectively, the ""BLAST Group"") shall not be liable for any claims, demands, injuries, damages, actions, or causes of action of or to myself or my guests or property, which arise wholly or partially due to the negligence of myself, or of any other person other that a member of the BLAST Group, and/or which arise wholly with the use of any services and/or facilities of BLAST, and I herby expressly forever release, hold harmless and discharge BLAST Group, and each and every member thereof, from any and all liability for such claims, demand, injuries, damages, actions or causes of action, and shall indemnify them for any costs, damages, actions, or expenses associated therewith. 5. Without in any way limiting the foregoing, I hereby aggress that in the event of any injury which I consider not waived pursuant to the provisions hereof, I shall, as a condition to make any claim against any member of the BLAST Group, and within ten (10) days following the occurrence giving rise to such injury, and at my own expense, be examined by a licensed physician who shall report in writing to both the undersigned and BLAST within ten (10) days following such examination. 6. I agree that no warranties, representations, or agreements of merchantability, fitness for a particular purpose, or otherwise, expressed or implied, were made to the undersigned. 7. I understand that certified BLAST instructors will teach me a unique, propriety workout formula. In exchange for being taught the BLAST formula, I agree that I will not attempt to teach the BLAST formula to others or use the BLAST formula outside a BLAST studio expect that I may use the BLAST formula for my personal workouts at home. 8. I agree that I am over the age of 18 years old. 9. I understand that there shall be no refund of the purchase price of any Series Package (single, 5 pack, 10 pack, 20 pack, 30 pack or derivate sessions) or Unlimited Package (3 month) unless the purchase was pre-paid in full prior to the first session and notice of cancellation is delivered to BLAST in writing within thirty (30) days following my first training session. Such refund shall be limited to the unused number of sessions at the price paid. BLAST shall have no obligation to me for any sessions beyond 12 months following the first session. 10. I agree to the BLAST late cancel policy. I will cancel a class I am scheduled for 8 hours prior to the start of class. If I am a series member I will lose that class. If I am a unlimited member I will be charged a single class fee. I agree I will be charged twice if I am signed up for a class and try to switch to a different class on the same day. I acknowledge I can cancel online on the Mindbody system, call the studio or email the studio.  11. I agree to keep a valid Credit Card on file at all times. BLAST requires a valid credit card on file for each account. If for any reason my credit card becomes invalid we will attempt to email you once. If we do not receive an updated card 12 hours prior to your next scheduled class we will cancel your reservation for that class to avoid potential unpaid reservations or Late Cancel fees. Failure to update your credit card information in 48 hours will result in account suspension. 12. I understand and agree that I can not cancel an unlimited package early and that I am responsible for all future payments. 13. I agree if I don’t arrive 5 minutes prior to class or call 15 minutes prior to class to reserve my spot if I am running late, my class spot may be given away. 14. I agree to opt-in to BLAST emails so I am ensured to receive class and wait-list confirmations. 15. I am 18 or older, or 16-17 with written parental consent to attend BLAST. 16. I agree to wear closed toe running shoes or I will not be allowed into the class. 17.I agree that BLAST, and its employees have the right to take photographs and videos of me. I authorize BLAST to use and publish the same in print and/or electronically. I agree that BLAST may use such photographs of me with or without my name and for any lawful purpose, including for example such purposes as publicity, training videos, and web or social media content.
